The protection of personal data is of great importance to Scuderia V GmbH.
We collect, process and use your personal data exclusively (a) on the basis of and within the scope of statutory powers or (b) with your separate declaration of consent.
The processing of personal data on our website takes place in accordance with the provisions of the General Data Protection Regulation (GDPR).

 

2. Data processing on our website

When you visit our website www.scuderiav.com, our webserver is temporarily storing any access in a protocol file. The following data are collected and stored until their automated erasure:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the file opened,
  • Transferred data volume
  • Message as to whether access was successful
  • Identification data of the browser and operating system used.

We process the data listed above for the purpose to allow the use of the website (connection establishment, for system security, for the technical administration of the network infrastructure, and to optimize our Internet offer. We cannot allocate these data to identifiable natural persons. We will not combine these data with information from other sources of data. In addition, any such data will be erased upon statistical evaluation.

The legal basis for processing the data is Art. 6, para. 1, sent. 1, letter f of the GDPR. Our legitimate interest is consistent with the purposes listed above for which we collect the data.

 

3. Transfer of data

Your personal data will not be transferred to third parties for purposes other than those listed below. We will transfer your personal data to third parties, only if:

  • you have given your express consent for such a transfer in accordance with Article 6, para. 1, sent. 1, letter a GDPR,
  • the transfer is necessary in accordance with Article 6, para. 1, sent. 1, letter f GDPR for the establishment, exercise or defense of claims under the law and there is no reason to assume that you have a justified overriding interest in not allowing your data to be transferred.
  • if we are legally obligated to transfer the data in accordance with Art. 6, para. 1, sent. 1, letter c GDPR, and
  • the transfer is permitted by law and in accordance with Art. 6, para. 1, sent. 1, letter b GDPR for the handling of contractual relationships with you.

When processing personal data via this website, we are assisted in part by selected service providers who, in accordance with their assignment, are strictly bound to the instructions we issue and whom we inspect before commencing their service activities and then regularly (Art. 28 GDPR).

 

4. Collection and processing of deliberately provided data

If you provide us with personal data by e-mail or via the contact form on our website (surname, first name, e-mail address, address), this is generally on a voluntary basis (Art. 6 para. 1 letter a GDPR). We use the data provided by you without your separate consent exclusively to answer your questions. The collection and further processing takes place on the basis of Art. 6 para. 1 letter b GDPR, insofar as the subject of your message is (pre-)contractual communication.

We will forward any contact enquiries through the contact form that are directed to Scuderia V GmbH to this entity for establishing direct contact on the basis of your consent given to us by your corresponding selection next to the form (Art. 6 para. 1 letter a GDPR).

A further use does not take place. Your data will then be erased for further use unless you have expressly consented to the further use of your data or statutory storage obligations prevent erasure (for example, if you send us a pre-contractual message via the contact form and we then establish a contractual relationship, or if your message relates to existing contractual relationships).

 

5. Use of Cookies

6. Creation of pseudonymized user profiles for website analysis

For the purpose of demand-oriented design and continuous optimization of our pages, we use Google Analytics, a web analysis service provided by Google LLC. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). On the other hand, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer. We carry out this processing exclusively on the basis of your previously given consent (see above under “Cookies”).

Google Analytics creates pseudonymized user profiles for us. The information generated by the Google Analytics cookie about your use of this website, such as

  • the operating system used,
  • Referrer URL (the previously visited page),
  • Host name of the accessing computer (IP address),
  • Time of the server request,

are transferred to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services associated with the use of the website and the Internet for the purposes of market research and demand-oriented design of these Internet pages. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of the company. Under no circumstances will your IP address be merged with other data from Google. The IP addresses are anonymized so that an assignment is not possible (IP masking).

7. Use of Google-Maps

Our website integrates Google Maps, a map service from Google that displays an interactive map. This is done on the basis of our legitimate interest in the user-friendly design of our online offer, namely in order to be able to present our locations to users on a map prepared by Google (Article 6, para. 1, sent. 1, letter f GDPR).

By visiting the website, Google receives the information that you have called up the corresponding subpage. In addition, further information about the use of this website (including your IP address) will be transmitted to and stored by Google on servers in the U.S.A. This is regardless of whether Google provides a user account that you are logged in with or whether no user account exists.

If you are logged in to Google, your information will be directly connected with your account. If you do not want this information to be connected with your profile on Google, you must log out of Google before visiting the site.

Google stores the data as user profiles and uses them for the purposes of advertising, market research and/or the design of its own web offers in line with requirements. Such evaluation takes place in particular (even for unlogged-in users) to provide demand-oriented advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact Google to exercise this right.

You can easily deactivate the Google Maps service to prevent data transfer to Google: To do this, it is sufficient to deactivate JavaScript in the browser used. Please note, however, that in this case you will not be able to use the map display.

8. Use of YouTube components with extended privacy mode

On our website we use components (videos) of the company YouTube, LLC 901 Cherry Ave, 94066 San Bruno, CA, USA, a company of Google LLC., Amphitheatre Parkway, Mountain View, CA 94043, USA.

We use the option ” – extended privacy mode – ” provided by YouTube for this purpose.

When you visit a page that has an embedded video, YouTube connects to the YouTube servers and displays the content on the website by notifying your browser.

According to YouTube, in ” – extended privacy mode – ” only data is transmitted to the YouTube server, in particular which of our websites you visited, when actually watching the video. If you are logged in to YouTube at the same time, this information will be connected with your YouTube member account. You can prevent this by logging out of your member account before visiting our website.

9. Social Media

On our website, we use links to the social network Facebook on the basis of Art. 6, para. 1, sent. 1, letter f GDPR in order to present and make ourselves better known via these platforms. The underlying advertising purpose is to be regarded as a legitimate interest within the meaning of the GDPR. The social network Facebook is operated by Facebook Ireland Ltd., 4 Grand Canal Square Grand Canal Harbour, Dublin 2, Ireland, whereby data is also transferred to Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA on a regular basis (Facebook Ireland Ltd. and Facebook Inc. hereinafter jointly referred to as “Facebook”). Facebook has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework, and is thereby committed to maintaining an appropriate level of privacy protection even when personal information is transferred to the United States.

When you access Facebook’s website from our website, your browser connects directly to Facebook’s servers. Facebook may then collect and process information for the purposes of advertising, market research and tailoring its pages to your needs. For this purpose, Facebook creates extensive usage, interest and relationship profiles, e.g. to evaluate the use of the websites and the Internet as a whole with regard to the advertisements displayed to the user, to inform other users of the social network about the activities of the user and to provide further services associated with the use of Facebook.

With regard to the use of our Facebook page, there is a joint controllership between us and Facebook within the meaning of Art. 26 GDPR. This applies in particular to the processing described below: When you visit our Facebook page, Facebook collects, among other things, your IP address and other information that is available on your PC in the form of cookies. To this end, we make use of our legitimate interest in interacting with active users of our Facebook page (Art. 6, para. 1, lit. f GDPR). If you have any questions, we offer you the opportunity to contact us via personal messages on Facebook. Your Facebook username will be automatically disclosed to us. Further information can be provided voluntarily, in particular contact options outside Facebook. Data processing for the purpose of contacting us is carried out in accordance with Art. 6, para. 1, sent. 1, lit. a GDPR on the basis of your voluntary given consent. The personal data processed by us for establishing contact will be automatically deleted after your request has been completed, unless this conflicts with legal storage obligations (e.g. because a contractual relationship between us has been established on the basis of your request).

 

10. Your rights and contact persons

Data subjects’ rights in accordance with the GDPR

You have the right:

  • under Art. 15 GDPR to request information concerning your personal data processed by us. In particular, you can request information on the purpose of the processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned length of time the data will be retained, your right to the correction, erasure, restriction of processing, your right to contest, your right to file a complaint, the origin of your data if it was not originally collected by us, and the potential existence of automated decision-making, including profiling, and, if so, reliable information on the details of such processes; we may only refuse to provide you with information if and to the extent that the information would disclose information which must be kept secret by law or by its very nature, in particular because of the overriding legitimate interests of a third party (§ 29 para. 1 sentence 2 BDSG), the competent public authority has determined vis-à-vis us that the disclosure of the data would endanger public safety or order or would otherwise be detrimental to the welfare of the Federal Government or a Land (§ 34 para. 1 BDSG in conjunction with § 33 para. 1 no. 2 letter b BDSG), or the data are only stored because they may not be deleted due to legal or statutory storage regulations or serve exclusively purposes of data backup or data protection control and the provision of information would require a disproportionate effort and processing for other purposes by suitable technical and organizational measures is excluded (§ 34 para. 1 no. 2 BDSG).

  • under Art. 18 GDPR to demand the restriction of processing of your personal data if you contest its accuracy, the processing is unlawful, the data subject opposes the erasure of the personal data and we no longer need the data, although you require it for the establishment, exercise of defense of legal claims, or you have contested its processing under Art. 21 GDPR.
  • under Art. 20 GDPR to receive your personal data that you have provided to us in a structured, standard and machine-readable format or to demand its transfer to another authorized person;
  • under Art. 7, para. 3, to retract your previously given consent at any time. If you do, we will no longer be able to continue any data processing that was based on this consent,
  • if your personal data is processed on the basis of justified interests in accordance with Art. 6, para. 1, sentence 1, letter f GDPR, under Art. 21 GDPR you can contest the processing of your personal data if grounds exist that are related to your particular situation or your objection is directed toward direct marketing. In the latter case you have a general right to contest processing of your personal data by us without having to describe your particular situation.

You also have a general right to file a complaint with the Data Protection Supervisory Authority having jurisdiction for you. The authority responsible for Scuderia V GmbH is the “Landesbeauftragter für den Datenschutz Sachsen-Anhalt“.
